How It Works

Leasehold service charges cover the cost of maintaining and managing communal areas of a building or estate. Common items include building insurance, cleaning, gardening, lift maintenance, communal lighting, management company fees and contributions to a sinking or reserve fund for major works. Charges vary widely from £500 to £5,000+ per year.

Under the Landlord and Tenant Act 1985, service charges must be reasonable, and landlords must consult leaseholders before carrying out major works costing more than £250 per leaseholder. Leaseholders have the right to challenge unreasonable charges at the First-tier Tribunal (Property Chamber).

What is service charge? Annual fee paid by leaseholders to freeholder/managing agent for common services. Leasehold flat owners almost always pay; freeholders may pay estate service charges. Average UK service charge 2026: £1,500-£3,500/year for typical block; £2,500-£8,000+ premium developments.

What you should and shouldn't pay for. Reasonable charges: insurance (compulsory), structural repairs, communal area maintenance, lift maintenance, fire safety compliance. Excessive charges to watch for: high-margin management fees (over 15% of service charge); freeholder 'commission' on insurance; unnecessary services. Right to challenge: First-tier Tribunal (Property Chamber) — can reduce charges if 'unreasonable'. Service charge transparency rules 2024+: improved disclosure required by law.

Major works — the unwelcome surprise. Section 20 consultation required for major works over £250 per leaseholder. Common: roof replacement, lift refurbishment, external decorations, structural repairs. Sample: 20-flat building, £100,000 roof replacement = £5,000 per leaseholder typical. Reserve fund (sinking fund) builds up annually to spread cost — but often inadequate. Check: how much is in reserve fund? Annual contributions and balance forecast. Many UK leaseholders shocked by £5k-£20k+ major works bills.

How to manage service charge. Demand annual accounts and budget. Compare to similar buildings (ask other freeholders). Right to Manage (RTM): leaseholders can take over management from freeholder (different building, different rules). Tribunal challenge: First-tier Tribunal hears service charge disputes — fee £100, possible to reduce charges.
